Refund Policy

This Refund Policy applies to all fees paid to Aashish Research Analyst (“Company”, “we”, “us”, “our”) for research reports, subscription plans, alerts, and any other services (collectively, “Services”) provided through our website https://aashishresearchanalyst.com/ (the “Site”).

1. General Policy – No Refund

By subscribing to our Services, you acknowledge and agree that:

  • Our research reports, recommendations, and analysis are intangible, digital goods that are delivered immediately or shortly after payment.
  • Once you receive access to our Services (including reports, login credentials, email/SMS alerts, or any proprietary content), you have effectively utilised the service.
  • Therefore, all fees paid are non-refundable, except in the limited circumstances described in Section 2 below.

This no-refund policy is necessary because:

  • Research and analysis have immediate value upon delivery.
  • There is no way to “return” or “un-receive” the intellectual property provided.
  • SEBI regulations do not mandate refunds for research services.

2. Limited Exceptions Where Refund May Be Considered

Notwithstanding the above, we may, at our sole discretion, consider a refund (full or partial) in the following exceptional cases:

Wrongful Charge / Unauthorised TransactionA payment was deducted due to a technical glitch on our payment gateway without your intent to subscribe. Proof required.

The following are NOT eligible for refund:

  • Change of mind or dissatisfaction with recommendations (past performance does not guarantee future results).
  • Trading losses incurred while following our recommendations.
  • Inability to trade due to personal reasons, technical issues on your end, or market closures.
  • Partial usage of subscription period (e.g., you used 15 days of a 30-day plan and now want a refund for remaining days).
  • Expiry of subscription without usage.

3. How to Request a Refund (for Eligible Cases Only)

If you believe your situation qualifies under Section 2 above, you must submit a refund request in writing within 7 days of the transaction date. Requests after 7 days will not be entertained.

To request a refund:

    • Registered email address and phone number

We will acknowledge your request within 2 working days and complete our review within 7 working days. If approved, the refund will be processed to the same payment method used originally within 7-10 working days.

4. Chargebacks & Dispute Resolution

If you initiate a chargeback with your bank or payment provider without first contacting us, we reserve the right to:

  • Permanently suspend your access to all Services.
  • Report the chargeback as a disputed transaction.
  • Pursue legal remedies for recovery of fees if the chargeback is found to be unjustified.

We encourage you to contact us first to resolve any payment-related concerns.

5. Cancellation of Subscription

You may cancel your subscription at any time from your account dashboard or by emailing us. However, cancellation does not entitle you to any refund for the remaining period. Your access will continue until the end of the current billing cycle, after which it will not renew.

2. Eligibility & Registration

  • You must be at least 18 years of age and legally capable of entering into a contract under the Indian Contract Act, 1872.
  • You must provide accurate, complete, and up-to-date information during registration, including PAN, address proof, and contact details, as required under SEBI’s KYC norms.
  • We reserve the right to reject any registration or suspend access if information is found false, incomplete, or non-compliant with regulatory requirements.

3. SEBI Compliance & KYC

We are a SEBI-registered Research Analyst (Reg. No. INH000013174). In compliance with SEBI regulations:

  • We maintain records of all client communications and recommendations.
  • We do not provide portfolio management services (PMS) or investment advisory services unless separately registered.
  • We do not guarantee any returns or assure any profits.
  • We follow strict conflict of interest policies as mandated by SEBI.

You agree to complete our KYC process before receiving any paid research services. We may request additional documents to verify identity, address, or financial status.

4. Services & Subscription

  • Free Services: We may provide free research reports, market updates, or sample recommendations. These are for informational purposes only and may be discontinued at any time without notice.
  • Paid Services: Detailed research reports, actionable recommendations, real-time alerts, and personalized analysis are available under paid subscription plans. Fees, duration, and scope will be as specified on our Site or in your subscription agreement.
  • No Refund: Except as provided in our Refund Policy, subscription fees are non-refundable once paid.
  • Service Modification: We reserve the right to modify, suspend, or discontinue any part of our Services without prior liability, subject to refunding unexpired subscription fees (at our discretion).

5. User Obligations

As a user, you agree:

  • We use third-party payment gateways. We are not liable for any issues arising from the gateway’s performance or data breach (though we choose reputed providers).
  • Subscription renewals may be automatic unless you cancel before the renewal date. Cancellation policies are specified on your invoice or subscription plan.

7. Intellectual Property

10. Termination

We may terminate or suspend your access to our Site and Services immediately, without prior notice, for any reason, including:

  • Provision of false KYC information.
  • Request by SEBI or any regulatory authority.

Upon termination, your right to use the Services ceases immediately. Any fees paid are non-refundable unless termination is due to our material breach.

You may terminate your subscription at any time by providing written notice, but no refund will be issued for the remaining subscription period.

11. Grievance Redressal

In compliance with SEBI (Research Analysts) Regulations, 2014 and the Consumer Protection Act, 2019, we have a grievance redressal mechanism. Please refer to our Complaint Policy page for the escalation matrix and contact details of our Grievance Officer.

If you are not satisfied with our resolution, you may lodge a complaint on SEBI SCORES 2.0 (https://scores.sebi.gov.in).

12. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, strikes, internet outages, government orders, or regulatory changes.

13. Amendments to Terms

We reserve the right to update or modify these Terms at any time without prior individual notice. Changes will be effective immediately upon posting on this page, with a revised “Last Updated” date. B. Details of Business Transacted by the Research Analyst with Respect to Investors

  • To publish research report based on the research activities of the Research Analyst.
  • To provide an independent, unbiased view on securities.
  • To offer unbiased recommendation, disclosing the financial interests in recommended securities.
  • To provide research recommendation, based on analysis of publicly available information and known observations.
  • To conduct audit annually.
  • To ensure that all advertisements are in adherence to the provisions of the Advertisement Code for Research Analysts.
  • To maintain records of interactions, with all clients including prospective clients (prior to onboarding), where any conversation related to the research services has taken place.

C. Details of Services Provided to Investors

1. Onboarding & KYC

  • Onboarding of Clients.
  • Sharing of terms and conditions of research services.
  • Completing KYC of fee-paying clients.

2. Disclosures to Clients

  • To disclose information that is material for the client to make an informed decision, including details of its business activity, disciplinary history, the terms and conditions of research services, details of associates, risks and conflicts of interest, if any.
  • To disclose the extent of use of Artificial Intelligence tools in providing research services.
  • To disclose, while distributing a third party research report, any material conflict of interest of such third party research provider or provide web address that directs a recipient to the relevant disclosures.
  • To disclose any conflict of interest of the activities of providing research services with other activities of the research analyst.

3. General Services

  • To distribute research reports and recommendations to the clients without discrimination.
  • To maintain confidentiality with respect to publication of the research report until made available in the public domain.
  • To respect data privacy rights of clients and take measures to protect unauthorized use of their confidential information.
  • To disclose the timelines for the services provided by the research analyst to clients and ensure adherence to the said timelines.
  • To provide clear guidance and adequate caution notice to clients when providing recommendations for dealing in complex and high-risk financial products/services.
  • To treat all clients with honesty and integrity.
  • To ensure confidentiality of information shared by clients unless such information is required to be provided in furtherance of discharging legal obligations or a client has provided specific consent to share such information.

D. Grievance Redressal Mechanism and How to Access It

1. Filing Complaint with the Research Analyst

In case of any grievance/complaint, an investor may approach Aashish Research Analyst who shall strive to redress the grievance immediately, but not later than 21 days of the receipt of the grievance.

2. Filing Complaint on SCORES 2.0

SCORES 2.0 is a web-based centralized grievance redressal system of SEBI for facilitating effective grievance redressal in a time-bound manner. Investors may lodge their complaint at: https://scores.sebi.gov.in[reference:22]

Two-level review for complaint/grievance against Research Analyst:

  • First review done by designated body (RAASB – BSE Limited)
  • Second review done by SEBI

3. SMARTODR Platform

If the Investor is not satisfied with the resolution provided, the Investor has the option to file the complaint/grievance on SMARTODR platform (https://smartodr.in/login) for resolution through online conciliation or arbitration.

4. Physical Complaints

Investors may send their physical complaints to:

F. Do’s and Don’ts for Investors

Do’s:

  • Always deal with SEBI registered Research Analyst.
  • Ensure that the Research Analyst has a valid registration certificate.
  • Check for SEBI registration number.
  • Inform SEBI about Research Analyst offering assured or guaranteed returns.

Don’ts:

  • Do not provide funds for investment to the Research Analyst.
  • Do not rely solely on research reports for investment decisions without understanding the risks involved.
  • Do not share your trading credentials or passwords with the Research Analyst.

G. Disclosure of Investor Complaints (Mandatory Monthly Disclosure)
